The order of Legend Items does not always match the orders MapLayers.

Solução Provisória
Create the legend. Then, move any layer in the TOC and move it's placement order (example: take layer 2 and drag it to be placed as layer 1). This will arrange the whole legend into the proper order. Then re-arrange the TOC back as it was.Etapas para Reproduzir
