Solución alternativa

Swap the ST_INTERSECTS arguments so that the shape argument is on the right and the query will execute although it may take a longer time to return the results. This goes against the KB35498 which outlines that the more selective geometry should be the right argument:http://resources.arcgis.com/content/kbase?fa=articleShow&d=35498
