Option 1:- If using CURRENT, execute the script from the Python Window instead of ArcToolboxOption 2:- Instead of using CURRENT, access the MXD by file pathOption 3:- If using CURRENT and executing the script via ArcToolbox, add a layer using MakeFeatureLayer tool coupled with the SetParameterAsText method as described in KB31981
