This issue is fixed in ArcGIS Pro 3.5.Workaround
Add a new graphics layer to the map. The Graphics contextual tab now appears in the activated map frame, even if the new graphics layer is removed. This workaround is temporary and does not persist after the project is saved, closed, and reopened.
