KML viewers do not draw data in a logical way like full GIS applications
Workaround
Remove the layer which is drawing on top from the map; convert that layer to KML directly via Layer to KML and add it in separately to Google Earth or ArcGIS Explorer.NOTE - Known limit of KML viewers: KML viewers draw layers from the top down (not the bottom up like GIS viewers do). To have layers draw as expected in KML, you need to reverse the ToC in ArcMap. However, this will create a potential "reverse" ToC in the output KML.
