Selecting points that ‘are within’ or that ‘intersect’ a polygon, the select by location query picks up points outside of the polygon shape file. This error occurs with a large number of user files, even after repairing the geometry as well as exporting to text and reimporting the features. It cannot be reproduced on data that has been created from scratch in house or by the user.

Workaround

Using the project tool on the shapefile, to change the projection to something different, then back again appears to cause the selection by location to behave properly.
