This behavior is expected. Opening a pop-up from a WMS service is essentially like opening an HTML page, the contents inside are unknown and rely on the response from the server for what gets displayed. So, regardless of where you click on the layer, the pop-up will always open and attempt to fetch the feature info from the server and display the results. Sometimes results will not be returned from the server and there is an empty pop-up.
