Additional Information

This is not a defect. To change the draw phase of the annotation right-click on it in the Table Of Contents and select Properties. Click the display tab and un-check the draw this layer in Table Of Contents order relative to other layers check box.

Workaround

Convert labels to annotations in the map document.
