An annotation layer that is set to be excluded from the clip by Data Driven Pages will be clipped when listed in the drawing order above other annotation feature classes that are clipped.

Workaround

1. Move the annotation layer below the other annotation layers.2. Uncheck 'Draw this layer in its table of contents order relative to other layers' on the display tab of the excluded annotation layer.
